Please read these Terms and Conditions ("Terms") carefully before using the website or services provided by Broke Ass Phone LLC. ("we," "our," or "us"). By accessing our website, scheduling a repair, or submitting a device for service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
We reserve the right to update or modify these Terms at any time. Continued use of our services after any changes constitutes your acceptance of the revised Terms.
1. Services Provided
Broke Ass Phone LLC. provides diagnostic, repair, and maintenance services for smart devices including but not limited to smartphones, tablets, laptops, smartwatches, and other consumer electronics ("Services"). Our Services are subject to device availability, parts availability, and technician assessment.
We reserve the right to refuse service at our discretion, including but not limited to devices that are:
Reported lost or stolen
Subjected to unauthorized modifications or previous third-party repairs that compromise safety
Damaged beyond economical repair
Under active insurance claims without prior authorization
2. Repair Estimates and Pricing
All repair quotes provided in person, by phone, or online are estimates only and are not guaranteed until a full diagnostic has been completed by our technicians. Final pricing may vary based on the actual condition of the device and parts required.
We will notify you of any changes to the estimated cost before proceeding with additional work. If we are unable to reach you for approval within [X] business days, we reserve the right to reassemble the device without completing the repair and charge a diagnostic fee.
All prices are listed in US Dollars and are subject to applicable sales tax and fees.
3. Authorization and Consent
By submitting your device for repair, you confirm that:
You are the lawful owner of the device or have explicit authorization from the owner to authorize repairs
You authorize Broke Ass Phone LLC. to perform the requested diagnostic and/or repair services
You understand that repair work may require powering on, resetting, or partially disassembling the device
You acknowledge that certain repairs may void any remaining manufacturer warranty on your device
4. Device Backup and Data Responsibility
YOU ARE SOLELY RESPONSIBLE FOR BACKING UP ALL DATA ON YOUR DEVICE BEFORE SUBMITTING IT FOR REPAIR. We strongly urge every customer to back up photos, contacts, messages, applications, and all other personal data prior to service.
While we do not access, view, copy, or retain any personal data stored on your device, data loss can sometimes occur as a result of the repair process, hardware failure, or necessary software procedures. Broke Ass Phone LLC. is not liable for any loss of data, files, or information that occurs during or after repair.
If you require assistance with backing up your device before your appointment, please contact us and we will be happy to help guide you.
5. Do Not Share Your Codes or Credentials
To protect your security and privacy, please observe the following rules regarding device access codes and credentials:
Do NOT share your permanent device passcode, Apple ID, Google account password, or any other account credentials with our staff — we will never ask for these
If device access is required for testing, set a temporary PIN before bringing in your device and change it immediately upon pickup
Never share two-factor authentication (2FA) codes, one-time passwords (OTPs), or verification codes with anyone — including our staff
Do not share your repair ticket number, confirmation codes, or account details with anyone other than verified Broke Ass Phone LLC. staff through official channels
Broke Ass Phone LLC. will never contact you by unsolicited phone, text, or email to request passwords, codes, or payment outside of our standard invoicing process
If you receive any suspicious communication from someone claiming to represent Broke Ass Phone LLC. and requesting sensitive information, please do not comply and contact us immediately to report it.
6. Parts and Repair Warranty
a. Parts
We use a combination of OEM (Original Equipment Manufacturer), OEM-equivalent, and quality aftermarket parts depending on availability and customer preference. Part type will be disclosed at the time of the repair estimate. Aftermarket parts may not carry the same specifications as original manufacturer parts.
b. Repair Warranty
Broke Ass Phone LLC. provides a limited warranty on parts and labor for a period of 90 days from the date of repair completion ("Warranty Period"), subject to the following conditions:
The warranty covers defects in the specific parts replaced and workmanship performed during the repair
The warranty does not cover new damage, liquid damage, physical damage, software issues, or problems unrelated to the original repair
The warranty is void if the device is subsequently opened, tampered with, or repaired by another party
Software-only repairs, unlocking services, and diagnostic-only services are not covered under this warranty
To make a warranty claim, please return your device to us within the Warranty Period with your original repair receipt.
7. Turnaround Time
Estimated repair times are provided as a courtesy and are not guaranteed. Turnaround time may vary depending on parts availability, repair complexity, and service volume. We will notify you as promptly as possible of any delays. Broke Ass Phone LLC. is not responsible for any inconvenience, loss of use, or damages resulting from repair delays beyond our estimated timeframe.
8. Unclaimed Devices
Devices that are not picked up within 30 days of repair completion or notification will be considered abandoned. Broke Ass Phone LLC. reserves the right to assess storage fees on unclaimed devices after 30 days at a rate of $5.00 per day. Devices left unclaimed for more than 30 days may be subject to disposal, recycling, or resale in accordance with applicable state laws, with any proceeds applied toward outstanding balances owed.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Broke Ass Phone LLC. and its owners, employees, and agents shall not be liable for:
Any indirect, incidental, special, consequential, or punitive damages
Loss of data, profits, revenue, or business opportunities
Damage to a device that is pre-existing, undisclosed, or caused by factors outside our control
Any damages arising from your failure to back up your device prior to service
Our total liability for any claim arising out of or relating to our Services shall not exceed the amount you paid for the specific repair service giving rise to the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Broke Ass Phone LLC. and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of our Services; (b) your violation of these Terms; or (c) any claim that your device was lost, stolen, or encumbered at the time of service.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law provisions. Any disputes arising under these Terms shall first be attempted to be resolved informally by contacting us directly.
